Are 1099 Delivery Drivers Covered by Workers' Comp?
No. Workers' compensation only covers employees, and a properly classified 1099 delivery driver is an independent contractor, not an employee. The real exposure is misclassification.
Why a 1099 Label Doesn't Automatically Exclude Coverage
Calling a driver a "contractor" on paper does not settle the question. If the actual working relationship looks like employment, a state agency or workers' comp carrier can reclassify that driver after an injury, and the claim proceeds as if they had been an employee the entire time.
The IRS Test Used to Determine True Worker Classification
The IRS evaluates classification using three factors:
- Behavioral control: Do you direct how, when, and where the work is done?
- Financial control: Does the driver use their own vehicle, cover their own expenses, and risk profit or loss?
- Type of relationship: Is the arrangement ongoing and central to your business, or a one-off project?
A delivery driver who works set shifts, uses a restaurant-owned vehicle, and takes direction on routes looks far more like an employee than a contractor, regardless of the 1099 form.
What Happens If a Misclassified Driver Gets Hurt?
If a driver is reclassified after an accident, you may owe:
- Back workers' comp premiums for the period they were misclassified
- Penalties and interest to your state's labor agency
- The full cost of the injury claim itself, as though coverage had existed all along
Misclassification does not shrink your exposure. It just delays when you pay for it.
Getting Driver Classification Right Before Someone Gets Hurt
